Adjustment/ division of pension rights:
- Since our office is located in Frankfurt/ Main, we have advised and represented bank and insurance company employees for decades.
Their pension schemes are often quite complex, many having even three schemes (legal, BVV, the pension scheme of the Germany finance industry, and company pension scheme).
Although retirement may be the last thing on your mind, as it may appear far off in the future, the importance of pensions remains. Many will find themselves with a dramatically reduced living standard after the divorce because they do not pay particular attention to this area. Dr. W. Spinner-Ahnert will make sure this topic is given the appropriate care to protect your future.
Many large corporations, and especially banks, offer additional pension schemes.
Only few lawyers are experienced in this field.
In a pure foreign nationals’ marriage (both partners are foreign nationals, but lived their conjugal life in Germany), the adjustment of pension rights (division) can possibly be avoided entirely. In this case, the divorce proceedings last only 3 to 4 months.
Pension payments resulting from longer marriages can easily amount to a monthly payment advantage/ disadvantage of several hundred Euro.
Taxes:
- Counselling also includes providing information on-and skilfully handling-the fiscal consequences of separation and divorce.
- Timing of tax class change
- (Limited) de facto splitting (“Realsplitting”) (deduction of spousal maintenance from the income)
- Joint assessment for income tax even in case of separation?
